President Donald Trump claims that the pardon signed by his predecessor, Joe Biden, is invalid. His reasoning: They allegedly signed with Autopen, a signature machine the U.S. government has used for decades. Unfortunately for Trump, the presidential pardon does not legally require signing at all.
On Monday, Trump announced that several pardons published by Biden were “ineffective, empty, without further force or effect, as they were done by automatic start” (emphasis on the original). Autostart is previously used by multiple presidents, and is a programmable machine with a robotic arm that can automatically write a given signature.

Specifically, Trump’s announcement targeted a pre-pardoned pardon by Byton to members of the House Committee, which investigated the January 6 attack on the U.S. Capitol. Biden granted the pardons hours before Trump took office, aiming to save House committee members from retaliation from the incoming president.
Trump has made no secret of his intention to pursue those investigating the attack, and has previously said in his social media platform Truth Social that they “should be tried “for fraud and treason.” Now the president is trying to remove the barriers to doing so, not only accusing Biden of not signing a pardon, but he is completely unaware that they are even happening.
“Joe Biden didn’t sign them, but more importantly, he knew nothing about them!” Trump’s social claim to truth. “The necessary pardon documents were not explained or approved to Biden. He knew nothing about them and did commit the crime.”
Trump has provided no evidence supporting the allegations. When reporters ask if such evidence exists, White House press secretary Karoline Leavitt simply says, “You are a journalist and you should find out.” Usually, the parties alleged to provide proof of their claims.
Biden issued a statement issued when he announced the pardon. He also talked about the possibility of releasing them in previous interviews.
Has Trump invalidated Biden’s presidential pardon?
Despite Trump’s attempt to invalidate Biden’s pardon, the president said members of the Truth Society Committee “are under the highest level of investigation” and that his declaration has no actual legal impact.
Whether Biden uses automatic open signing of House Committee pardons or not, no signature is required to grant the president’s pardon. In fact, as Trump suggests, there are no “necessary pardon documents.” Last year, the U.S. court determined that while the presidential pardon in writing proved that this happened, the Constitution simply didn’t need to write it down, let alone sign it. As mentioned earlier, Biden’s statement made it clear that he had issued a pardon.

Even if signatures are required, automatic open use will not invalidate the document. Although the validity of documents signed by automatic start has not been tested in court, the U.S. Department of Justice (DOJ) issued an opinion in 2005 saying that it is legal for the president to sign a bill by automatic start. The proposal was in response to former President George W. Bush’s guidance request on the matter.
“The president does not have to personally enforce the bill he approved and decide on the physical behavior of a bill that he signed into law,” the Justice Department wrote. “Instead, the president may sign a bill …for example, directing subordinates to post a president’s signature on such a bill, such as by automatic release.”
Barack Obama became the first U.S. president to sign a bill through the automatic opening bill when he expanded the Patriot Act in 2011. He then used the bill to sign the bill when he could not sign it in person. Biden also uses auto-start to sign at least one bill. If all files using auto-start signatures are found to be invalid, there may be significant consequences far beyond the impact of the House Committee.
U.S. officials have used auto-start to sign letters for decades, including former Secretary of Defense Donald Rumsfeld and former Presidents John F. Kennedy and Lyndon Johnson. Trump himself admitted to using automatic open and told reporters on Sunday: “We can use this as an example to send a letter to some young people because it’s good.” However, Trump claimed he did not use the machine to sign the consequence documents.

Trump acknowledged on Sunday that the validity of Biden’s pardon would be a question of the court’s decision, although the White House has not yet raised any legal challenges. Even so, regardless of the lack of evidence, the president seems to have made up his mind.
