R. Kelly’s legal team has filed an emergency motion seeking immediate release from federal custody to family detention, claiming his life is at risk and accusing the government of misconduct.
In Tuesday’s documents, reviewed typeKelly’s attorneys claim they have clear evidence that officials were murdered by inmates in a federal prison in North Carolina, where he was sentenced to 30 years in prison.

His lawyer swore in prisoner Mikeal Glenn Stine, who said officials provided him with freedom in the final days in exchange for Kelly’s murder. Sting claims he was told Kelly that his attorney was planning to reveal information about damages as documents say officials violated the attorney-client privilege by intercepting personal letters. Sting said officials told him he would be charged with Kelly’s murder, but the evidence would be inappropriate and without belief.
Aryan Brotherhood leader Stine arrived at Kelly’s unit last March and, despite his preparation to kill him, changed his heart and told Kelly that prison officials directed him to commit the murder. Kelly’s lawyers claimed that in June, they learned of the second member of the Aryan Brotherhood, who was directed by officials to kill Kelly and Stine. They claimed Kelly was still in danger because he was still detained with other members of the fraternity.
“The threat to Mr. Kelly’s life is not taking any action every day,” the document said. “More AB members are accumulating in his facilities. There has been more than one person in the murders of him. One of them will certainly do something Mr. Stine doesn’t have, thus burying the fact that happened with Robert Kelly.”

The singer, whose name is Robert Sylvester Kelly, was initially convicted of nine counts of replacing the indictment in September 2021. In June of the following year, he was sentenced to 30 years in prison. In February 2023, Kelly was sentenced to 20 years in prison for child sex crimes, and the judge ruled that his first 30 years of prison sentences would serve at the same time, except for all sentences of one year.
Last February, the Court of Appeal upheld Kelly’s conviction of racket and sex trafficking and his 30-year prison sentence. The court rejected his claim that the trial evidence was insufficient and the trial judge made an inappropriate ruling.
